These Terms of Service (“Terms”) govern your access to and use of our services, including the rental of ice bath equipment (“Services”), provided by Dubai Ice Baths (“Company,” “we,” “our,” or “us”). By placing an order, booking a rental, or using any of our Services, you agree to these Terms in full.
Please read these Terms carefully. If you do not agree with any part of these Terms, do not use our Services.
1. Eligibility
To use our Services, you must be at least 18 years of age. By using our Services, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding contract with us.
2. Ice Bath Rental Services
When renting equipment from Dubai Ice Baths, you are agreeing to all rental terms, conditions, and fees as stated in your order and this ToS. All rentals are subject to availability, and we reserve the right to refuse any order at our sole discretion.
3. Disclaimer and Waiver of Liability
3.1 Health Disclaimer: Dubai Ice Baths does not provide medical advice. Our ice bath Services are not a substitute for medical treatment, and we do not make any guarantees regarding the health benefits or risks of cold therapy. Please consult with a medical professional before using an ice bath, especially if you have any pre-existing medical conditions.
3.2 Use at Your Own Risk: By placing an order with Dubai Ice Baths, you acknowledge and agree that any use of our equipment is at your own risk. We shall not be responsible for any injuries, health issues, or medical conditions that may arise from using our Services, including but not limited to cold-related illnesses, injuries, or other health complications.
3.3 Limitation of Liability: Dubai Ice Baths, including our employees, affiliates, agents, and representatives, shall not be liable for any damages, injuries, health issues, claims, or losses of any kind that may occur as a result of your use of our equipment or Services, whether direct, indirect, incidental, or consequential. This includes, but is not limited to, property damage, personal injury, and wrongful death.
4. Equipment Care and Responsibility
As the renter, you are responsible for the proper use, care, and return of our equipment in its original condition. Any damages incurred during the rental period, whether accidental or due to improper use, will be your responsibility, and repair or replacement fees may be charged accordingly.
4.1 Loss or Damage: If equipment is lost, stolen, or damaged while in your possession, you will be responsible for any repair or replacement costs. We reserve the right to assess damages and charge accordingly.
5. Payment Terms
All rental fees must be paid before the time of booking, and you agree to pay any applicable taxes and fees. In the event of damage to the equipment, you agree to cover all repair or replacement costs as assessed by us.
6. Cancellation Policy
Cancellations must be made at least 7 days prior to the rental start date to qualify for a refund. Cancellations made after this period may be subject to a cancellation fee as outlined at the time of booking.
7. Indemnification
You agree to indemnify and hold harmless Dubai Ice Baths, including our employees, agents, affiliates, and representatives, from any and all claims, losses, damages, expenses, or costs, including reasonable attorney fees, arising out of or related to your use of our Services or any violation of these Terms.
8. No Warranty
Dubai Ice Baths provides all Services on an “as is” basis, without warranties of any kind, express or implied. We disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or related to these Terms or our Services shall be resolved exclusively in the courts of Dubai.
10. Changes to Terms
Dubai Ice Baths reserves the right to modify or update these Terms at any time. Changes will be effective immediately upon posting to our website, and continued use of our Services constitutes acceptance of any changes.
